The risk of compliance on paper

A framework may look complete on paper and remain weak in practice. Deficiencies in due diligence, monitoring, reporting or governance may lead to administrative consequences and, where the law provides, additional liability.

02

What to examine

Prevention starts with demonstrating not only that a control exists, but that it is performed, supervised and corrected.

  • ownership and escalation lines;
  • quality and timeliness of reviews;
  • rationale for exceptions;
  • tracking of deficiencies and remediation;
  • appropriate information to governing bodies.
03

How to read an enforcement measure

A public measure is useful when broken into four elements: requirement or expectation, observed weakness, control cause and verifiable remedy. The penalty amount alone teaches little; the operational value lies in identifying which control failed and which evidence could have demonstrated execution.

04

Illustrative control case

A sample shows reviews formally closed within SLA, but several exceptions have no owner, rationale or escalation evidence. The procedure exists and the KPI looks positive; operating effectiveness is weak because the file does not demonstrate how exceptions were handled.

Useful check: for one key control compare design, population, sample, exceptions, escalation, evidence and remediation. If one step survives only in team memory, the control is not fully reconstructable.
